Odense is a French handcrafted costume jewelry brand managed by Sophie Baillet as a sole proprietorship (microenterprise) registered with the Chamber of Trades and Crafts of Nanterre.

These terms of sale are concluded between Odense, registered under the SIRET number 890 127 319 00014 – head office established at 17 rue Saint Maurice in Nanterre, microenterprise registered with the Chamber of Trades and Crafts of Nanterre, hereinafter referred to as the “seller”, and any natural or legal person willing to make a purchase via the website www.odense.fr, hereinafter referred to as “the buyer”.

Article 1. Object

These terms of sale aim to define the contractual relationship between Odense and the buyer and the applicable conditions to any purchase made through the website www.odense.fr. By adquisiting a product through this site, the buyer agrees to these terms of sales, which the buyer acknowledges having read, before placing his/her order. Before any transaction, the buyer declares that the purchase of products on the site www.odense.fr is not directly related to his/her professional activity, and is stricly limited to personal use, and, on the other hand, declares to be fully legally entitled to commit to the following Terms of Sales.

When recording personal data on the site, the Client must verify and ensure the accuracy and completeness of the mandatory data he/she provides. In the event of an error in the wording of the recipient’s contact details, Odense cannot be held responsible for any resulting problems this error has caused.

The seller reserves the right to modify these terms of sale at any time and without previous notice, in order to comply with any new regulations or to improve the use of his/her site. Therefore, In this case, the applicable conditions will be the ones in effect at the date of the order by the buyer. Any order placed on the Site from the seller entails the buyer’s full acceptance of these Terms of Sales.

Article 2. Products

The offered products are those appearing on the site www.odense.fr, within the limits of available stocks. The seller reserves the right to modify the assortment of products at any time. Each product is presented on the website in the form of a description showing its main technical characteristics (capacity, use, composition, etc.). The descriptions and photographs of the products sold on the site are as accurate as possible but they do not bind the seller in any way.

Product descriptions and prices are subject to change at any time without notice, at our sole discretion. We reserve the right to stop making a product at any time.

The photographs and texts illustrating the products are not contractual. We cannot guarantee that the display of colors on your computer screen will be accurate. Odense.fr presents jewelry assembled by hand with quality materials, so certain lengths indicated in the descriptions may be subject to a variation of 10%. Likewise, certain used materials may present irregularities related to the craftmanship or their natural properties. The sale of the products presented on the website www.odense.fr is intended for all buyers residing in countries that fully authorise entry of these products onto their territory.

Jewelry may be returned or exchanged in conformity with our Return Policy.

Article 3. Pricing

The prices appearing on the Product sheets of the online catalog are stated in Euros (€) excluding taxes (Ms. Sophie Baillet, micro-entrepreneur, is not subject to VAT – Article 293B of the General Tax Code), excluding shipping fees and/or any costs related to custom clearance fees. Any modification in the prices of raw materials may be reflected in the price of the products. The seller reserves the right to change prices at any time, it being understood, however, that the price listed in the catalog on the day of the order will be the only price applicable to the buyer. The prices indicated do not include any packaging costs (gift boxes) and delivery costs invoiced in addition to the price of the products purchased according to the total amount of the order. The packaging, order processing and shipping costs are indicated before the order is confirmed. In metropolitan France, for any order of 100 euros or more, shipping costs are free.

Article 4. Terms of order and payment

Before any order, the buyer must create an account on the site www.odense.fr. The account creation section is accessible directly from the side menu bar. On each visit, if the buyer wishes to order or consult his/her account (order status, profile, etc.), must identify him/herself using this information.

The seller shall not be liable for the consequences for erroneous information transmitted by the buyer resulting in the non-performance of the service covered by these Terms of Sales.

The price is payable in cash, in full, on the day the order is placed by the buyer, by secure payment according to the following terms:

Payment by credit card only (Visa, Eurocard / Mastercard): the buyer selects the products he/she wishes to order in the “shopping cart”, modifies if necessary (quantities, references, etc.), checks the delivery address or provides a new one. Then, the shipping costs are calculated and submitted to the buyer, along with the name of the carrier. Then, the buyer chooses the payment method of his/her choice: payment by credit card. The next step is to check all the information, read and accept these terms of sale by checking the corresponding box, then he/she is asked to validate the order by clicking on the “Confirm my order” button. Finally, the buyer is redirected to the interface secured by the SSL (Secure Socket Layer) protocol in order to safely fill in his/her personal credit card references. If payment is accepted, the order is registered and therefore, the contract is succesfully created. Payment by credit card is irrevocable. In the event of fraudulent use thereof, the buyer may demand the cancellation of the payment by card, the sums paid will then be credited or returned. The responsibility of the holder of a bank card is not engaged if the disputed payment has been proven fraudulently, remotely, without physical use of his card. To obtain reimbursement of the fraudulent debit and any bank charges that the operation may have generated, the cardholder must contest, in writing, the debit from his bank, within 70 days of the operation, or even 120 days. if the contract binding him to it so provides. The amounts withdrawn are reimbursed by the bank within a maximum period of one month after receipt of the written objection lodged by the holder. No cost of restitution of sums can be charged to the holder.

Any order will only be deemed validated after payment has been accepted. The seller will be entitled to refuse or cancel any order relating to a buyer in dispute over a previous order.

Orders are accepted within the limits of available stocks. Any definitive or temporary unavailability of a product shall not engage the responsibility of the seller whatsoever, and cannot entitle the buyer to compensation or damages.

We reserve the right to refuse any order that the buyer places, or to reduce or cancel the quantities purchased per person, per household or per order. In the event that we modify an order or should we cancel it, we will notify the buyer via the email address and/or billing address, and/or telephone number provided at the time the order was placed. We reserve the right to limit or prohibit orders which, in our sole judgment, may appear to be from merchants, resellers or distributors.

The buyer agrees to provide up-to-date, full and accurate information for bank account and all orders placed on our website.

Any placement of an order implies the seller’s unreserved acceptance of these terms of sales, the recognition of having full knowledge of them and the renunciation to ones own terms of purchase. All the data provided and the recorded confirmation will constitute proof of the transaction. If the buyer has an email address and if he/she has entered it on his/her order form, the seller will email him/her a confirmation of the registration of his/her order.

Article. 5 Retention of title

The website Odense.fr keeps the full and whole property of products sold up to the perfect payment of the price, the principal, expenses and taxes were included.

Article 6. Retractation

Under article L221-28 of the Consumer Code. the buyer has a period of fourteen working days from the delivery of his/her order to exercise his/her right of withdrawal and thus, make a return of the product (in its original packaging, never worn, unwashed) at his/her expense to the seller for exchange or refunding without penalty, with the exception of return costs which will be borne by the buyer.

The withdrawal period runs from the date of receipt of the product by the buyer until the date of shipment indicated on the return package.

  • By the carrier of his/her choice, at his/her expense;
  • Within 14 (fourteen) working days, the postmark or the carrier serving as a proof;
  • Enclosing the delivery note and any customs documents

The right of retractation, exercised properly, allows the buyer to obtain a refund of his/her order within a maximum period of thirty days after receipt by the seller of such products. The refund will be made according to the same payment method chosen by the customer when ordering.

Exceptions to return order :

  • Earrings, for hygiene reasons
  • Personalized jewelry or those made according to the buyer’s specifications will not be returned or exchanged under the provisions of Article L 121-21-8 of the Consumer Code

Article 7. Delivery/Shipping

The delivery time for all models depends on the available stock: within 48 hours (working days) if all the items in the order are in stock, or as soon as the product is manufactured (4 to 8 days) if the stock is not available. Deliveries are made to the address indicated on the order form, which can only be located in the agreed geographical area. Orders are made by La Poste via COLISSIMO, delivery service with tracking and delivery with signature. Delivery times are only indicative and correspond to the average processing and delivery time of the package; if these exceed thirty days from the order, the sales contract may be terminated and the buyer reimbursed. Odense will be able to provide the buyer with the tracking number of his/her package by e-mail. The buyer is delivered to his/her home by his/her postman. If the buyer is absent, he/she will receive a calling card from his postman, which allows him/her to collect the products ordered at the nearest post office, during a period indicated by the postal services. The risks related to transport are the responsibility of the buyer from the moment the items leave the seller’s premises. The buyer is required to check in the presence of the La Poste employee or the delivery person, the condition of the packaging of the goods and their contents upon delivery. In the event of damage during transport, any protest must be made to the carrier within three days of delivery.

The jewelry is delivered worldwide. For overseas departments and territories and abroad, depending on the postal services, the time will be longer and variable, and beyond our control.

Your jewelry leaves our workshop in a bubble envelope, carefully packaged, so we cannot be held responsible for delays, non-distribution, loss and/or theft and/or damage caused during transport.

No delivery can be made to a hotel or post office box address.

Shipping costs include preparation and packaging costs as well as postage. The preparation costs are fixed, while the transport costs vary according to the total weight of the package. We recommend that you consolidate all of your items into one order. We cannot combine two orders placed separately and shipping costs apply to each of them.

– Europe & International : Colissimo – 5 to 10 days

Article 8. Warranty

All the products supplied by the seller benefit from the legal guarantee provided for by articles 1641 and following of the Civil Code. In the event of non-compliance of a product sold, it may be returned to the seller who will take it back, exchange it or refund it. All complaints, requests for exchange or reimbursement must be made by post to the following address: Ms. Sophie BAILLET – 17 rue Saint Maurice – 92000 Nanterre, within thirty days of delivery.

Any abnormal or non-compliant use of the products, as well as the consequences of such use or of external causes are excluded from the scope of contractual guarantees.

Article 9. Responsability

The seller, in the distance selling process, is held only by a best effort undertaking. its responsibility could not be committed for a damage resulting from the use of internet network for example, losses of data, intrusion, virus, interruption of service, or any case of force majeure.

The following non-exhaustive points are considered as cases of force majeure, in addition to those usually retained by the case law of French courts and tribunals: total or partial strikes, in particular by the postal services, lock-out, riot, boycotts or other actions of a nature. industrial or commercial litigation, civil unrest, insurrection, …

If the force majeure continues beyond fifteen days, the contract may be terminated without entitling one or the other party to compensation.

Article 10. Intellectual property

All the elements of the www.odense.fr website shall remain the intellectual and exclusive property of Mrs. Sophie BAILLET. No one is authorized to reproduce, exploit, or use for any purpose, even partially, elements of the site whether in the form of a photo, logo, visual or text whatsoever. Only private use is authorized.

Article 11. Personal data

The seller is committed to preserving the confidentiality of any information provided by the buyer, which would have to be transmitted for the use of certain services. Any concerning information is subject to the provisions of the law “Informatique et Liberté” n ° 78-17 of January 6, 1978 modified on June 1, 2019. Article 12. Rules for disputes and mediation

These distance selling conditions are governed to French law. In the event of disputes or litigation, the buyer will contact the seller with a view to obtaining an amicable solution. In the event of a dispute, the French courts have exclusive jurisdiction and you acknowledge that you accept their exclusive jurisdiction.

In the event of a dispute, and in accordance with the provisions of the Consumer Code, before any legal action, the customer has the right to use, free of charge, the mediation service offered by the seller.

In accordance with Articles L.616-1 and R.616-1 of the Consumer Code, we offer a consumer mediation system. The mediation entity retained is: CNPM – MEDIATION – CONSUMATION. This mediation procedure can only be triggered in the event that the seller’s customer service has not responded satisfactorily to your request. Mediation aims to seek and offer an amicable and personalized solution to disputes between the buyer and the seller.
